Media Release Policy

1. The Participant grants the Company a perpetual, assignable, sublicensable, irrevocable, royalty-free right and license to use, reproduce, distribute, publicly perform, publicly display, and edit any audio recordings of the Participant that the Company creates or obtains (the “Audio Recordings”).

2. The Company shall have the right to use the Audio Recordings for any promotional purpose, including but not limited to advertising, marketing, and press releases.

3. The Participant hereby waives any and all claims or rights to compensation or other consideration arising out of the Company’s use of the Audio Recordings.

4. The Participant shall indemnify and hold the Company harmless from and against any and all claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or in connection with the Company’s use of the Audio Recordings.

5. The unrestricted right and permission to copyright and use, re-use, publish, and republish photographic portraits or pictures of me or by me that were shot to promote NewNew Foods, Inc./CAcafe, in which I may be included intact or in part, composite or distorted in character or form, without restriction as to reproduction hereof in color or otherwise, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose related to NewNew Foods, Inc./CAcafe.
6. I hereby relinquish any right that I may have to examine or approve the completed product or products of an advertising nature that may be used in conjunction with the picture(s) of myself mentioned in section a.
7. I hereby release, discharge, and agree to save harmless NewNew Foods, Inc./CAcafe, his/her heirs, legal representatives or assigns, and all persons functioning under his/her permission or authority, or those for whom he/she is functioning, any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the aforementioned picture(s) or in any subsequent processing and sharing thereof, including without limitation any claims for libel or invasion of privacy.
